ANTT defines measures to enable toll exemption for trucks

Agency establishes vehicle inspection conditions

SÃO PAULO – The National Land Transport Agency (ANTT) defined technical and operational measures through which highway concessionaires must verify that a cargo vehicle is circulating empty, a condition that grants the driver exemption from toll charges on suspended axles according to the Truck Drivers Law.

In a resolution published this Wednesday in the Federal Official Gazette, ANTT defines that the condition of an empty cargo transport vehicle can be verified in four ways: from visual assessment, tax documentation associated with the trip, the Identification Code of the Transport Operation or the total gross weight of the vehicle.

The verification can be done in specific toll booths, weighing stations or through inspection by ANTT or by the traffic authority with jurisdiction over the highway.

The agency's resolution determines that each highway concessionaire under ANTT regulation must submit an operational proposal within 90 days to verify the empty condition of cargo transport vehicles. The proposal may provide for the application of any of the four established forms, separately or together.

The free toll per suspended axle for empty cargo vehicles is provided for by law 13.103, of March this year, the so-called Truck Drivers' Law.

A Presidency decree published in April defined that, until the implementation of technical and operational measures to enable the exemption from charging the tariff, cargo vehicles that passed through tolls with one or more suspended axles would be considered empty, unless there was inspection by the condition by an authority.

In São Paulo, the charge was maintained by decision of Artesp, the state regulatory agency, which defined that the provisions of the law do not apply to São Paulo highways.
