Decree regulates parts of the new Truckers Law

The federal government published this Friday, 17th, in the Federal Official Gazette (DOU) the Decree No. 8.433, which regulates parts of the new Law of Truck Drivers, sanctioned last month and which also provides for the exercise of the profession of driver.

Among other points, the text – quite expected by the category – confirms that empty cargo transport vehicles will be exempt from toll charges on the axles they keep suspended.

The scope of the benefit, however, will still need new regulations. According to the decree, “the competent bodies or entities of the Union, States, Federal District and municipalities will provide for the technical and operational measures to make the exemption feasible”.

Until the implementation of the measures, the regulation allows - cargo transport vehicles that cross the toll plazas with one or more axles that they keep suspended are considered empty, except for inspection of the condition by the authority with jurisdiction over the road or its surroundings. designated agent.

In the case of federal highways granted, regulation of the exemption will be the responsibility of the National Land Transport Agency (ANTT), which will have a maximum period of 180 days to do so, says the text.

With the publication of the decree, the ANTT board should meet today to approve a resolution with the operational details of the application of the new legislation, which will directly influence toll tariffs on federal highways.

Tariffs may receive an extra readjustment to compensate concessionaires for losses resulting from the law.

As now trucks that circulate empty will not pay tariffs on axles that are suspended, contrary to what happened, there will be a reduction in toll revenues, especially on routes where cargo traffic is more intense.

The agency informed that, as it is a regulatory body, it is its duty to ensure the economic-financial balance of contracts. That is, there will be some kind of compensation to dealers for lost revenue.

If it will be a tariff readjustment and how much it will be, these are still points that are under discussion.
