The federal government wants to create a state-owned company to take care of the elaboration of projects for highways, ports, airports and other infrastructure works. This state-owned company would have a special regime for contracting and would not need to follow the current rules of the Bidding Law. The information was published this Thursday by the newspaper Folha de S. Paulo.
For this, the government should soon send a package of measures to Congress aimed at creating a new modality for contracting specific projects in the area of infrastructure. Named “PPP Mais”, the proposal seeks to attract private investment to works considered strategic by the government.
The working group that prepared the proposal is composed of lawyers, attorneys and specialists in public tenders.
According to one of the members of the commission, Carlos Ari Sundfeld, the proposal is of great relevance and needs to be treated as a priority to help resume investment.
The idea of a state-owned company focused on the development of infrastructure projects is not new. In 2012, the government created the Planning and Logistics Company (EPL) which aims to prepare studies for the interconnection of ports, highways, waterways, airports and railways. At first, the company had a relevant role in the sector, but it has been losing political space in the government.
One of the main complaints of private companies that participate in biddings is related to the license release process. To try to circumvent the problem, the new state-owned company should have a consortium in each project, formed by the different areas involved in the process of granting authorizations.
